As counselors, we offer advice and guidance that have been battle-tested through litigation. We spend considerable time and energy educating clients to avoid mistakes that lead to lawsuits. As litigators, we fight for our clients while remaining mindful of their broader business concerns and have substantial experience successfully representing clients in state and federal court and before regulatory agencies. Attorney Biographies

Steven H. Winterbauer (Partner),
Steve is the firm’s founder and managing member. He began his legal career at Foster, Pepper & Shefelman, where he became a partner and served as Chair of the Employment and Labor Group. Steve has over twenty-five years of experience counseling and litigating in employment and labor matters. He counsels employers through the employment and labor implications of mergers, acquisitions, reductions-in-force, early retirement programs, successive planning, and plant closures. He has successfully defended companies before state and federal courts, as well as administrative agencies.

Steve also has significant experience prosecuting and defending claims related to employee mobility and the disposition of business assets, including, for example, claims for breach of non-competition, non-solicitation and no-hire agreements, breach of fiduciary duty, violation of The Federal Computer Fraud Act, and trade secret misappropriation. His arbitration experience ranges from private arbitration pursuant to mandatory arbitration agreements to traditional labor arbitration, to public sector interest arbitration.

Kenneth J. Diamond (Partner),
Ken joined the firm as a Member in 1997. His counseling practice extends to every facet of the employment relationship, including recruitment, hiring, training, and discharge. He works with employers regarding major restructures, compliance audits, and the removal of high-level executives. He has defended large and small employers on the full range of employment litigation matters (e.g., discrimination, retaliation, FMLA, reasonable accommodation, contract disputes) and has significant experience defending wage & hour class-action cases alleging misclassification of employees.

Prior to moving to Seattle, Ken practiced in Washington, D.C. with Covington & Burling and Chadbourne & Parke.

Ami M. De Celle (Associate),
Ami’s practice focuses on employment-related litigation, labor arbitration, and workplace investigations. She has successfully represented employers in state and federal court, in grievance hearings and before numerous administrative enforcement agencies, including the Equal Employment Opportunity Commission, the Washington Human Rights Commission, the federal Department of Labor, and the Washington Department of Labor and Industries.

Ami also has substantial experience conducting wage/hour audits and investigating a broad range of employment-related issues, including internal complaints of discrimination, harassment and retaliation.

Before joining the firm, Ami served as Judicial Extern to the Honorable Jeremy D. Fogel at the U.S. District Court for the Northern District of California.

Vanessa B. Chambers (Associate),
Vanessa’s practice focuses on employment-related litigation. Prior to joining the firm in 2011, Vanessa served as a Judicial Extern for the Honorable Marsha J. Pechman of the U.S. District Court for the Western District of Washington, and successfully completed the practicum for mediation certification.

Nicholas Gillard-Byers (Associate),
Nick’s practice focuses on employment-related litigation. Prior to joining the firm in 2016, Nick represented clients in a variety of intellectual property matters and served as attorney-advisor to Chief Administrative Law Judge Paul J. Luckern at the United States International Trade Commission.

Nate Bailey
Nate represents employers of all sizes in the full range of employment-litigations matters, including discrimination, harassment, retaliation, unfair competition, wage and hour, and breach of contract.  Nate also counsels employers on matters including employment contracts, employer handbooks and policies, discipline and discharge, compliance with medical leave and disability laws, and other issues.
