Answer from Maryland

Effective January 2015, employers that do business in Prince George’s and Montgomery County Maryland may be barred by County law from asking about the criminal history of applicants on employment applications (i.e. the “box” is “banned”) or before the first interview is concluded. District of Columbia law, effective December 17, 2014, bars such inquiries until after the recruitment process has resulted in a conditional offer of employment. These jurisdictions join Baltimore City as well as several States (including most recently, the State of New Jersey) in imposing restrictions on criminal history inquiries.

The State of North Carolina has not enacted statewide legislation banning the box, but several cities have as follows, for job applications for positions with those municipalities: Carrboro, Charlotte, Cumberland County, Durham, Durham County, Spring Lake.
