EEOC's EEO-1 Component 1 Filing Deadline Set for December 5, 2023

While suspended after the COVID-19 pandemic, the Equal Employment Opportunity Commission (“EEOC”) has now resumed data collection through the online EEO-1 report. The EEO-1 Component 1 report is a mandatory annual data collection obligation that requires all private sector employees with 100 or more employees and certain federal contractors to submit demographic workforce data. Qualifying federal contractors include those with 50 or more employees and either have a federal contract or subcontract worth more than $50,000.00, act as an issuing and paying agent for United States Savings Bonds, or serve as a depository for government funds.
The EEOC has opened the online filing portal from October 31, 2023, until Tuesday, December 5, 2023, for EEO-1 Component 1 filings.
The EEO-1 seeks to provide the EEOC with a “workforce snapshot” requiring an employer to include the following information about their employees:
• Race and Ethnicity
• Job Classification
While the EEOC frequently proposes changes to the reporting requirements for EEO-1 reports, none of those changes have been enacted to date. However, as employers make necessary programming and personnel changes after the December 5, 2023, deadline, they should be mindful that additional formatting changes or information may become necessary to disclose in future EEO-1 filings.
